Important! By accepting the Regulations for the provision of electronic services of the Getthebox Platform, you also accept the Stripe Services Agreement and the Stripe Services Agreement. This is a necessary condition for using the Platform as a verified driver.

General provisions

Subject of the Regulations

  1. These Regulations constitute the regulations for the provision of electronic services within the meaning of the Act of July 18, 2002 on the provision of electronic services and specify the rights and obligations of the Operator and Users in their mutual relations, in particular:
    1. types and scope of services provided electronically;
      terms and conditions of providing electronic services;
    2. the procedure for concluding a contract for the provision of electronic services;
    3. the right to withdraw from the contract for the provision of electronic services;
    4. complaint procedure.
  2. The Platform may be used only in accordance with the terms and conditions set out in the Regulations and solely on the basis thereof - neither the Operator nor other Users are bound in their mutual relations by the General Terms and Conditions of Contracts or other templates of User contracts, if Users used such templates.
  3. The use of certain Services or promotions may be subject to additional provisions, e.g. regulations of the Services and promotions, about which the User will be informed separately before using these Services. Additional provisions supplement the Regulations for the purposes of the relevant Services. In the event of any conflict between additional provisions and the Regulations, the additional provisions shall prevail.
  4. Before using the Platform and Services, Users are obliged to read the Regulations and the Privacy Policy (available here). The User declares that he has read the Regulations and the Privacy Policy and accepts all their provisions by checking the appropriate box when registering an Account. Without registering an Account, it is not possible to use the Platform and Services.
    The Regulations of the Platform are available free of charge on the website www.getthebox.eu/regulamin, and also in the Application in a way that enables the acquisition, reproduction and recording of their content. In particular, the User may download the Regulations in PDF format without any restrictions, save the Regulations on their storage media and print them in any number of copies.

Service provider and contact details

  1. The owner of the Platform is Kampo Przemysław Kędzierski with its registered office in Zębowice 33i, 59-411 Paszowice, NIP 6951438816, REGON 391077790 (hereinafter referred to as the "Operator").

Definitions

Any capitalized words whose meanings are defined below should be understood as follows:

  1. Application – software for a mobile device, necessary to use the Services offered within the Platform; installing the Application means accepting the license agreement;
  2. Driver – a User offering other Users the opportunity to Transport a Parcel in exchange for participation in costs (Driver being an Individual User) or in exchange for an agreed remuneration (Driver being a Professional User);
  3. Consumer – User who is a natural person who performs a legal transaction unrelated to his business or professional activity;
  4. Account or User Account - an individual User account on the Platform, the creation of which is necessary to use the Services, containing the User's basic data and individual preferences for using the Services ("Your profile" tab);
  5. License – license for the Application;
  6. Materials – descriptions of Advertisements and any other content made available on the Platform by the User;
  7. Sender - the entity that delivers the shipment to the Driver for Transport, it may be the User, but does not have to be;
  8. Recipient - the entity that receives the shipment from the Driver, it may be the User, but does not have to be;
  9. Advertisement - an announcement by the User revealing the willingness to send a Parcel for Transport ("Sender's Zone") containing the name, telephone number and e-mail address of the Sender and Recipient, the address of sending and receiving the Parcel, a description of the shipment with details whether a tow truck or a vehicle with permissible total weight above 3.5 t, as well as remuneration and payment method;
  10. Operator - Kampo Przemysław Kędzierski based in Zębowice 33i, 59-411 Paszowice, NIP 6951438816, REGON 391077790;
  11. Platform - a complex of Getthebox Services and functionalities enabling the exchange of information between Users and their interaction in order to conclude a Transport Agreement;
  12. Shipment or Goods - a movable item that is to be the subject of Transport;
  13. Transport – an activity consisting in transporting a Parcel on the basis of an agreement concluded between Users;
  14. Regulations - these regulations constituting the regulations for the provision of electronic services within the meaning of Art. 8 section 1 of the Act of 18 July 2002 on the provision of electronic services;
  15. Registration – all activities included in the procedure of creating a User Account;
  16. Transport Agreement - a shipment/goods transport agreement concluded between Users via the Platform, i.e. using means of distance communication;
  17. Mobile device - portable telecommunications device intended to be connected directly or indirectly to network termination points, i.e. telecommunications terminal device within the meaning of Art. 2 point 43 of the Act of 16 July 2004 Telecommunications Law, e.g. mobile phone (smartphone), tablet;
  18. Services provided electronically or Services - all services provided by the Operator electronically via the Platform on the terms arising from the Regulations and the Privacy Policy;
  19. User - a natural person with at least limited legal capacity and at least 18 years of age, as well as a legal person or an organizational unit without legal personality, with legal capacity and capacity to perform legal acts, who has successfully set up a User Account on the Platform and has access to Services;
  20. Individual User - a User who is a Consumer, occasionally offering to transport cargo to a specific destination indicated by another User during the trip, in a vehicle with a maximum permissible weight of up to 3.5 tons in order to share the costs of the trip;
  21. Professional User - a User offering the transport of Parcels to the destination indicated by another User, in a vehicle with any permissible total weight, running a business related to transport and forwarding and having - if required by law - a license to perform domestic road transport of goods, a Community license for international road transport commercial road transport of goods, possibly other authorizations/consents necessary to perform a given type of activity.
 

Technical conditions for using the platform

  1. Correct use of the Services offered via the Platform is possible provided that the User's IT system meets the following minimum technical requirements:
    • For access to the Platform via an application for mobile devices - within all functionalities of the Platform: Mobile device with access to the Internet equipped with a compatible Android or iOS operating system. Information about compatible versions of Android and iOS systems is available in the online application stores Google Play and Apple AppStore. Downloading the Application from the above-mentioned shops are free;
    • For access to the Platform via the website www.getthebox.eu - in terms of registration, searching and adding Parcels for Transport:
      1. a computer or other device that supports a web browser; efficient internet connection;
      2. a web browser enabling the display of hypertext documents (HTML, PHP) on a computer screen with software for Java Script and Java applets installed - information on compatible browser versions is published on the Platform's website;
      3. Cookies support enabled;
      4. having a current, active and properly configured e-mail account;

    When using the Getthebox website, cookies are installed in the User's IT system. The condition for using the Online Store is to enable the installation of cookies (see XIV. Privacy Policy).

  2. The application provides access to all functionalities of the Platform, while the Getthebox website enables registration, searching and adding Parcels for Transport.
  3. Using the Application requires an Internet connection and may involve the activation of paid mobile data transmission, in accordance with the regulations of the mobile operator used by the User, taking into account any roaming fees.
  4. The technical conditions of use of the Platform are important for the proper functioning of the Platform. The Application User is responsible for the quality of the mobile device used to access the Platform, including technical problems or possible technical limitations (lack of sufficient memory, lack of Internet connection, blockages by firewall or antivirus programs, inaccurate GPS module and others), and which may hinder or prevent the User from using the Platform.
  5. The User may report irregularities related to the functioning of the Platform in writing at biuro@kampo.com.pl or using the contact form.

 

Application license

  1. Provided that the User complies with the Regulations, the Operator grants the User a limited, non-exclusive, revocable and non-transferable license without the right to grant sublicenses to: (i) access and use the Application on their own Mobile Device solely in connection with the use of the Platform; and (ii) accessing and using any content, information and related materials that may be made available on the App.
  2. The application is subject to the copyright of the Website Operator. All graphic elements, logos, trademarks, colors and interface layout, as well as the Application itself, are protected by copyright, trademark rights, database rights and other intellectual property rights.
 

Services and rules of using the platform

  1. Through the Platform, the Operator enables the exchange of information between Users for the purpose of Transporting Parcels and for this purpose provides the following Services constituting the functionalities of the Platform:
    • Via the App:
      1. registration of a User Account,
      2. providing the User Account in the "Your profile" tab,
      3. managing added Parcels and adding Advertisements in the "Sender's Zone" tab,
        searching for Advertisements and planning a route in the "Plan route" tab, including filtering Advertisements according to the "hide: Tow truck needed" and "hide: "Above 3.5 t" functions;
      4. managing accepted Parcel Transport offers in the "Driver Zone" tab,
      5. concluding Transport Agreements between Users using means of distance communication via the Internet;
      6. possibility of making cashless settlements between Users and the Operator via the external PayPal.Me service and payments in the application for the iOS platform (In-App Purchases).
    • Via the website www.getthebox.eu:
      1. registration of a User Account,
      2. searching for Parcels for Transport,
      3. adding Parcels to Transport via a QR code or the "share" functionality, which involves sending a given Advertisement to the e-mail address indicated each time.
  2. The Operator provides free services on the Platform (downloading and installing the Application, registering a User Account, adding Advertisements, searching for Advertisements, route planning and concluding Transport Agreements between Users using means of distance communication via the Internet) and paid services (accepting shipments for Transport by Drivers). Paid services are provided only at the express request of the User; the fee is charged only to the Users who transport the Parcel, i.e. the Drivers.
  3. The Platform may be used only on the terms set out in the Regulations and Privacy Policy.
  4. The Operator will make every effort to ensure that all Services made available via the Platform operate continuously without interruption 24/7, but informs that there may be disruptions in the functioning of the Platform, in particular caused by unauthorized interference by Users or third parties, failure of the Application or force majeure. In addition, access to the Platform may be temporarily blocked due to planned technical maintenance, work aimed in particular, but not exclusively, at changing or adding further functionalities. The Operator will keep Users informed about planned interruptions in access to the Platform in advance and about the planned restoration of the Platform's operation.
  5. The User acknowledges that the Services are provided using an IT system ensuring processing and storage, as well as sending and receiving data via telecommunications networks. Using services provided electronically via the Internet involves risk. Information about specific risks related to the use of services provided electronically can be found at www.getthebox.eu/zagrozanie.
 

Restrictions on the use of the platform/bans

User's responsibility

  1. Users act solely at their own risk and are responsible for any events that may or have occurred in the real world between them and other Users.
  2. The User is responsible for the Materials transmitted and published on the Platform, for their truthfulness, reliability and authenticity. The operator is unable to verify compliance with the above. information with the actual state.
  3. It is prohibited to use the Platform, including the Services, for purposes that violate applicable law, the provisions of the Regulations or good practices. Users are prohibited from sending illegal content.
  4. It is prohibited to use the Platform, e.g. Advertisements, for purposes other than those resulting from its nature, in particular it is prohibited:
    1. conducting advertising and promotional activities, including providing company names, trade names, trademarks, etc.;
    2. including business cards (contact details), website addresses, telephone numbers, and announcements not related to the Transport of Parcels in the content of the Advertisements;
    3. taking any actions that may cause harm to other Users or the Operator.
  5. Content posted by Users, including Advertisements, cannot contain profanity or aim to spread hatred, racism, fascism, communism or xenophobia. The Service Provider reserves the right to delete Advertisements if their content violates the provisions of the Regulations, applicable law or good practices.
  6. The User undertakes to indemnify the Operator and members of its bodies, including members of the management board, employees and representatives from liability for any claims, demands, losses, liabilities and expenses (including legal fees) arising from or in connection with: (i) the use by the User from the Services; (ii) violation by the User of any of the provisions of these Regulations; (iii) the User's violation of the rights of any third party, including Third Party Service Providers.

Operator's liability

  1. The Operator is not a party to any agreements, contracts or contractual relations of any nature between Users, nor does it have any influence on their performance, i.e. in particular, it does not provide transport services via the Platform and is not a carrier, and all transport/transport services are provided by Users constituting the Platform community; The Operator only provides access to the Platform and takes care of its development.
  2. The Operator is not able to and does not in any way control the correctness and truthfulness of the Advertisements and their compliance with applicable law, and does not guarantee the correct performance of the Transport by Users, and does not bear any responsibility in this regard, in particular it does not assume liability for:
    1. including false or unreliable information in the Advertisement regarding the Transport and its conditions or providing such information to other Users in any other way;
    2. cancellation or modification of the Transport by the User;
    3. improper performance or non-performance of the Transport, in particular failure to pay for the Transport performed or loss or damage to the Shipment.
  3. The Operator will accept reports from Users about violations of the Regulations and the Privacy Policy by other Users (e.g. failure to deliver the Parcel, damage or destruction of the Parcel, failure to pay for the Transport of the Parcel), or about threats generated by other Users or their inappropriate behavior, and will respond to these reports reacted appropriately in accordance with the provisions of the Regulations, including section VII. 7.
  4. The Operator excludes its liability towards Professional Users resulting from both the warranty pursuant to Art. 558 § 1 of the Civil Code, as well as from general provisions, with the exception of intentional fault.
 

Account registration

The condition for using the Platform is the User's registration by creating an Account. Registration means concluding an agreement between the User and the Operator for the provision of electronic services for the use of the Services via the Platform for an indefinite period. Registration is free of charge.

Registration conditions and restrictions

  1. The Platform is available only to natural persons with at least limited legal capacity and at least 18 years of age, as well as legal persons or organizational units without legal personality, having legal capacity and capacity to perform legal acts. By creating an Account, the User confirms that he or she meets the above-mentioned requirements. criteria.
  2. One person can only have one Account on the Platform. It is not allowed to assign or make the Account available to other people, and it is not allowed to use the accounts of other Users under pain of blocking or deleting the account (see the section "Limiting, blocking and deleting the Account"). However, it is possible to use the Platform also on a mobile device that does not belong to the User, using their own data to log in to the Application.

Create an account

  1. You can register a User Account directly in the Application or on the Getthebox Platform website www.getthebox.eu in the "Search for Parcels" or "Contact" tab. Registration takes place using a Facebook account or creating a separate account by providing an e-mail address and password. For this purpose, the User must consent to access to the data indicated by the Platform, and in addition
    1. read and accept the Regulations and the Privacy Policy by checking the appropriate check box and pressing the button indicating acceptance;
    2. consent to the processing of personal data for the purpose of registering and maintaining a User Account (granting consent to transfer data from Facebook to the Application); upon registration, the User consents to the processing of personal data for other purposes, e.g. marketing, etc.; the user consents to receiving newslatter messages to the e-mail address provided during registration or added on the website www.getthebox.eu in the place designated for this purpose.

      Submitting declarations marked with an asterisk is necessary to register an Account and use the Platform.
  2. In order to use all functions of the Platform - accepting Parcels for Transport by Users who are Drivers or cashless settlements by Users sending or receiving Parcels, the User sending or receiving Parcels must also provide a telephone number and verify his account in the "Your Profile" tab - verification is carried out by Stripe.
  3. By linking with the Facebook Account, the Application gains access to the following personal data of the User available in the public profile: name, surname and profile photo of the User. The photo is visible only to the User.
  4. The User may at any time remove the connection between the Application and the Facebook account by sending a request to the Operator in the manner described in the section "Limiting, blocking and deleting the Account", however, this will be tantamount to deleting the Account from the Platform.
  5. Regardless of the chosen registration method, the User is obliged to provide complete and true information and update it via the "Your profile" tab each time it changes, in order to ensure its correctness for the duration of the contract.
  6. The User is obliged to keep the password confidential and not to disclose it to third parties.
  7. If the password is lost, the User can recover the password via Facebook, as login is done using the Facebook login and password.
  8. The User may express separate consent(s) to receiving advertising and commercial information from the Operator or third parties via electronic means. The User may at any time opt out of receiving the above advertising and commercial information by activating the appropriate internet address found in each advertising or commercial information provided or by using the appropriate function in the Application.
Restriction, blocking and deletion of the Account
  1. The User may at any time remove his/her Account from the Platform free of charge by sending an e-mail from the e-mail address currently registered in the User's Account to the following address of the Operator: biuro@getthebox.eu, clearly disclosing the will to delete the Account from the Portal.
  2. The User's request to remove the connection between the Application and the Facebook account is tantamount to a request to remove the Account from the Platform.
  3. The Account will not be deleted despite the request if there are unsettled commissions assigned to the Account, which the User is obliged to pay to the Operator.
  4. Deleting the Account is tantamount to terminating the contract for the provision of electronic services concluded between the User and the Operator for the use of the Services via the Platform. Any ratings, rankings, ratings, e.g. the number of packages transported (when such functionalities are made available) will be irretrievably lost and impossible to recreate after re-registering the Account.
  5. Uninstalling the Application from the Mobile Device is not tantamount to deleting the Account from the Platform, just as deleting the Account is not tantamount to uninstalling the Application from the Mobile Device. In order to delete the Account on the Getthebox Platform, the User is obliged to use the procedure described in section. 1 above, in order to uninstall the Application, the User should use the system options of the Mobile Device.
  6. Termination of the contract for the provision of electronic services results in the deletion of all User data in the Account, unless:
    1. unsettled commissions are assigned to the Account, which the User is obliged to pay to the Operator,
    2. legal provisions state otherwise, or
    3. deleting all data entered by the User from the IT system is not possible due to the nature of the Service provided electronically;
    4. there are other legal bases for the processing of personal data described in the Privacy Policy.
  7. If the Operator finds that the User violates the provisions of the Regulations, the Operator may limit the Account by limiting access to individual Services (e.g. the ability to send Parcels or accept them for Transport) or block access to the Account or even delete the Account along with providing appropriate information in this regard. scope for all Platform Users. These rights are granted to the Operator after prior notification to the User, in particular in the case of:
    1. using the Platform in a manner contrary to its intended purpose or to the detriment of third parties and disrupting the functioning of the Platform regardless of the techniques of operation;
    2. failure to log in to the Platform for a period of 12 months from the last login;
    3. one User has more than one Account - in such a case, all User Accounts may be deleted;
    4. if the User, within a period of 3 months from limiting or blocking the Account by the Administrator, does not take the actions necessary to remove the reasons constituting the basis for blocking;
    5. the User's violation of applicable law or decency.
  8. The Operator may restore full functionality of the Account or unblock the Account after the User has completed the indicated actions or after the expiry of a specified period of time indicated by the Operator as a sanction for violating the Regulations.
 

Parcel transport services

Basic conditions for sending and receiving Parcels and performing Transport

  1. The subject of the Platform's activity is to associate Users for the purpose of Transporting Goods. It is prohibited to use the Platform to transport persons, animals and materials that are illegal, dangerous or require special transport conditions.
  2. It is prohibited to post and accept Advertisements on behalf of and for the benefit of other Users.
  3. All contacts regarding the implementation of the Transport contract will take place, with the exception of the Operator, only between interested Users.
  4. The Getthebox Platform only acts as an intermediary in matching Users for the purpose of Transporting Goods, therefore meeting the conditions set out in these Regulations does not release Professional Users from the obligation to complete all formalities required by law, including obtaining appropriate permits, issuing and delivering consignment notes.

Sending Parcels

  1. The Application allows the possibility of ordering Parcel Transport by both the Sender and the Recipient, as well as by a User who is neither the Sender nor the Recipient and who would like to transport a parcel from one entity - the Sender to another entity - the Recipient who is not a User of the Platform.
  2. The user can place an order in three ways:
    • Cash (Pays by the sender) – the user places an order on the Getthebox platform free of charge, and the sender settles accounts with the driver when collecting the shipment for transport
    • Cash (paid by the recipient) – the user places an order on the Getthebox platform free of charge, and the recipient settles accounts with the driver upon delivery of the parcel
    • Prepayment – when placing an order on the Getthebox platform, the user pays the transport fee in advance using a credit or ATM card, and the driver receives remuneration when collecting the shipment for transport. This remuneration is first credited to his account in the application, and then once a week it is transferred to the driver's bank account.
  3. A User who would like to send a Parcel should use the "Sender's Zone" tab and complete the following data:
    1. description of the Shipment - presenting a short description of the Shipment, e.g. dimensions, weight, number of pieces, method of packaging (Euro pallet),
    2. indication whether the Transport requires a tow truck or a vehicle with a permissible total weight above 3.5 t or a removal or Animal Transport or a Parcel for an orphanage
      identification of the payer of the Transport Service as the sender ("Sender Pays") or Recipient "(Recipient Pays);
    3. indication of the Sender's data: name, telephone number and e-mail address, as well as the address of sending the Parcel,
    4. indication of the Recipient's data: name, telephone number and e-mail address, as well as the address of receipt of the Parcel.
  4. Providing the above information is necessary for the proper performance of the Service by other Users of the Platform, however, not all information provided in the Advertisement will be visible to other Users:
    1. after completing the Advertisement form and accepting it by the User, the Advertisement becomes visible to all other Users of the Platform only to the extent of the address of sending and receiving the Parcel provided in the Advertisement;
    2. after the User who is a Driver has booked the Parcel, the User will be provided with the Sender's contact details in order to contact him and determine the details of picking up the Parcel, while the Sender will be provided with a QR code or PIN to the e-mail address indicated in the Advertisement to be used to pick up the Parcel by the Driver along with Driver's data and details about the Shipment, including the place of shipment, place of pickup and description of the Shipment;
    3. After the Driver picks up the parcel, the Recipient will receive a QR code and PIN for collecting the parcel, along with the Driver's data and details about the Parcel, including the place of shipment, the place of collection and a description of the Parcel, at the e-mail address and telephone number indicated in the Advertisement.
  5. Reserving a Parcel causes a temporary blocking of the Parcel for other Platform Users for whom the Parcel is still visible but unavailable for booking. The shipment is unblocked if the Driver resigns from transporting the shipment or the reservation time expires.
  6. The User sending the Parcel may edit the content of the Advertisement and may delete the Advertisement at any time, including after the Driver has accepted the Parcel for transport. In such a case, the User sending the Parcel is obliged to collect the parcel from the Driver at his own expense and risk (e.g. in person, through another User or by post or courier) and pay the entire remuneration for the Transport specified in the Advertisement.
  7. All data included in the Advertisement by the User should be provided reliably and be true.
Searching for and receiving Parcels
  1. A driver who intends to transport a parcel can search for it before the planned journey in the Application in the "Plan route" tab or on the Getthebox Platform website www.getthebox.eu in the "search for parcels" tab, indicating the starting point and destination of his trip. In order to set the starting point of the journey, the Driver can use the option of automatically downloading the GPS position if he is at the starting point of the journey, and in order to add a Parcel found on the Getthebox Platform website for transport, the User can search for this parcel in the Application or scan it with a Mobile Device with installed Application, the QR code posted on the website or use the function of sharing the Parcel via e-mail address via the Getthebox Platform website.
  2. If there are no Parcels to be transported at the place of departure of the journey, the Driver can set the travel destination and the search radius in the Application (expressed in kilometers, no larger than that indicated in the Application), and the Application will continuously search for Parcels to be sent at a given distance from the Driver's current location. , taking into account the planned route and the destination and the indicated search radius as potential places to collect the Shipment.
  3. After the Driver finds an appropriate Advertisement for a shipment without the "paid" option, the driver must pay a fee for showing the number. When you want to take a "paid" shipment, you just need to have a verified Stripe account. After making a reservation, the Parcel is added to the "Driver's Zone" tab, the Sender of the Parcel automatically receives a QR code and PIN for sending the Parcel to the e-mail address and telephone number provided in the Advertisement, and the Driver receives access to the Sender's contact details in the Application, with which can arrange the details of picking up the Shipment. The shipment should be picked up no later than within 1 hour. The sender cannot extend this period.
  4. The parcel is picked up by the Driver scanning the QR code sent to the Sender or entering the PIN code into the Sender's Application. When it is indicated in the Advertisement that settlement takes place at the time of shipment, the Driver settles with the Sender in cash or non-cash via PayPal.Me, and the Application allows the settlement method to be changed from non-cash to cash.
  5. An individual User who is a Driver undertakes not to demand more remuneration for the Transport than the actual costs incurred in order to obtain any profits, and moreover - on the basis of shared costs - an Individual User who is a Driver must bear his or her own share of the costs related to the Transport. The Driver is solely responsible for calculating the costs incurred as part of the Trip and checking whether the amount required from other Users does not exceed the actual costs incurred (taking into account the User's own contribution).
  6. Upon receipt of the Parcel, the risk of accidental loss/damage to the Parcel is transferred to the Driver.
  7. The Driver may resign from Transporting the Shipment no later than the time it is picked up. The Driver should immediately inform the User sending the Parcel about the resignation from the Transport of the Parcel, i.e. by sending an SMS or by phone. The shipment of the shipment is also canceled automatically if the reservation time for the shipment specified in point expires. 3 above. After collecting the parcel from the Sender, the Driver cannot resign from the Transport of the Parcel, which means that he is obliged to deliver the Parcel to the Recipient. The Driver is liable to the User sending the Parcel for the proper performance of the contract.
Collecting Parcels
  1. After picking up the shipment, the Recipient automatically receives a QR code and PIN for collecting the Parcel along with the Driver's data and details about the Parcel, including the place of shipment, the place of collection and a description of the Parcel, to the e-mail address and telephone number provided in the Advertisement, while the Driver receives in the Application access to the contact details of the Recipient, with whom he or she can arrange the details of the delivery of the Parcel.
  2. The Parcel is collected by the Driver scanning the QR code sent to the recipient or entering the PIN code into his Application. When the Advertisement states that settlement takes place at the time of pickup, the Driver settles with the Recipient in cash or non-cash via PayPal.Me, and the Application allows the settlement method to be changed from non-cash to cash.
  3. In order to be able to take "paid" orders, a driver must create an account on the Stripe platform and verify his/her data such as name and surname and residential address. Creating an account and verifying it is necessary to collect your remuneration. This verification takes place on the Stripe platform. By using this function, you agree to Stripe's privacy policy: https://stripe.com/en-pl/privacy. The Getthebox platform is not responsible for the data collected by Stripe. Getthebox does not collect or archive data that Stripe requires.

User Credibility

The Operator may introduce a functionality consisting in publishing an individual counter of Parcels transported by a given User. A large number of transported parcels may build the status of a given User as an experienced person, but it does not mean that a User who does not have any transported parcels is unreliable.

Security

In the event of fraud, loss or theft of the shipment, the case will be reported to the police and, after prior clarification with the application users, Kampo Przemysław Kędzierski may refund compensation for the shipment in the amount of up to PLN 500.

 

Transport payment rules

  1. Payment for the Transport is made at the discretion of the User sending the Parcel at the time of sending the Parcel (i.e. handing over the Parcel to the User who is the Driver for delivery by the Sender) or collecting the Parcel (i.e. handing over the Parcel to the Recipient for collection).
  2. Payment for Transportation is made non-cash - via Stripe, which collects the necessary data for user verification
  3. The Driver may withhold the delivery of the Parcel to the Recipient if the Recipient does not offer payment for the Transport performed in accordance with the information included in the Advertisement. In such a case, the User sending the Parcel is obliged to collect the parcel from the Driver at his own expense and risk (e.g. in person, through another User or by post or courier) and pay the entire remuneration for the Transport specified in the Advertisement.
  4. Users are obliged to resolve mutual claims between themselves, without the mediation of the Operator, who is not a party to the Transport Agreement and is not liable in accordance with the "Operator's Liability" chapter,
  5. For each Transport with the "paid" label, the driver is deducted a commission from the transport amount of 8%. The funds are deducted when the driver collects the shipment from the sender for transport and the driver enters the PIN code received by the sender by e-mail when adding the order to the platform.
  6. For each card transaction when issuing an order to the Getthebox platform, a fixed fee is charged for the so-called fixed costs in the amount of PLN 1 plus 1.4% of the amount deposited.
  7. The driver is required to pay a "1-day access" or "monthly subscription" fee at the time of discovering the number. To view the sender's number, the driver has 4 payment options to choose from:
    • Access for 1 day (the package includes 3 issues to discover) – PLN 2.99
    • Access for 1 day (the package includes 9 issues to discover) – PLN 4.99
    • Monthly subscription (the package includes 30 issues to discover) – PLN 29.99/month
    • Monthly subscription (the package includes 90 issues to discover) – PLN 49.99/month

  8. The User's balance can be verified in the "Your Profile" tab.

Individual users

  1. Individual users undertake to use the Services via the Platform only occasionally in order to establish contacts on a non-commercial and non-business basis in order to minimize the costs of travel.
  2. The amount of remuneration for the Transport of the Parcel is determined by the User who intends to send the Parcel. An individual user who is a Driver is aware that it is prohibited to obtain any profits from the use of the Platform. Due to the above, the User undertakes to accept only such Advertisements, the remuneration of which will cover part of the costs actually incurred in connection with the Trip. Otherwise, the individual User bears the full risk of changing the tax classification of the transaction concluded via the Platform.

Professional users

  1. Professional users can accept all Advertisements, regardless of the amount of remuneration set therein and the frequency of Transportation.
  2. Professional Users issue bills or invoices at the request of Users who send Parcels, or Senders or Recipients of Parcels, in accordance with the arrangements made between them.
 

Complaints

  1. Each Application User has the right to submit a complaint in matters related to the operation of the Application and the Services offered through it.
  2. Complaints should be submitted via e-mail: biuro@kampo.com.pl or in writing to the following address: Kampo Przemysław Kędzierski. 59-411 Paszowice, Zębowice 33i.
  3. A complaint should contain the User's data enabling his/her identification and contact (e.g. name and surname or login and e-mail address or postal address) and an indication of the circumstances justifying the submission of a complaint. Only complaints submitted in Polish will be considered.
  4. Complaints will be considered on an ongoing basis, without undue delay, within no more than 14 days from the date of receipt of the complaint; The Operator will notify the User about accepting or refusing to accept the complaint in the above-mentioned form. time to the e-mail address or postal address provided by the User in the complaint.
  5. If the consideration of a complaint requires unusual, special actions and arrangements, the deadline for considering the complaint may be extended. The Operator reserves that the consideration of a complaint may require obtaining additional explanations from the User, and the time for providing explanations by the User each time extends the period for examining the complaint.
  6. Complaints addressed to the Operator regarding services provided by third parties via the Portal should be submitted directly to these third parties.
 

Right to withdraw from the contract

  1. An individual User may withdraw from the Agreement for the provision of electronic services (for maintaining an Account in the Application) without giving a reason within 14 days from the date of its conclusion (from the date of registration of the Account on the Platform). The contract is concluded upon completion of registration, i.e. upon activation of the Account. In order to meet the deadline, it is enough to send the declaration before the deadline.
  2. To exercise the right to withdraw from the contract, it is necessary to send clear information about withdrawal via:

      • individual User data, i.e. name and surname or login,
      • current e-mail address (provided during registration or later when editing the Account) or postal address (in the case of sending the statement by post),
      • signature in the case of correspondence by post or fax.

        Instructions on withdrawal from the Agreement constitute Appendix No. 1 to the Regulations. An individual user may also use the withdrawal form constituting Appendix 2 to the Regulations, available here.
  3. If the declaration of withdrawal is delivered electronically, the Operator will immediately send confirmation of receipt by e-mail to the User's e-mail address.
  4. Loss of the right to withdraw from the Agreement - the Operator informs that starting to use the functionality of the Platform by logging in to the Application after registering an Account means the User's request to provide the Service before the deadline for withdrawing from the Agreement expires and the loss of the right to withdraw.

Applicable law - dispute resolution

  1. In all matters not regulated in the Regulations, the provisions generally applicable in the Republic of Poland apply, including the Civil Code, the Act of May 30, 2014 on consumer rights for individual users and the Act of July 18, 2002 on the provision of electronic services.
  2. The Service Provider informs that in connection with the Services provided:
    1. does not apply ethical codes within the meaning of Art. 661 § 2 point 6 of the Civil Code or the Code of Good Practices within the meaning of the provisions on counteracting unfair market practices,
    2. does not collect deposits from Users or request other financial guarantees,
    3. does not provide warranty or offer after-sales services,
    4. does not deliver any items or goods.
  3. All disputes arising from the provision of services electronically will be considered by competent courts in accordance with the provisions of the Code of Civil Procedure, or other acts and acts of generally applicable law, with the exception of disputes involving Professional Users, for which the court based on the Operator's registered office will have jurisdiction.
  4. The Operator does not use out-of-court resolution of disputes referred to in the Act of September 23, 2016 on out-of-court resolution of consumer disputes. Disputes arising from the provision of services electronically may be considered by an arbitration court only after the complaint procedure has been completed and if both parties to the dispute consent thereto.
  5. A User who is a Consumer may obtain free assistance in resolving a dispute between the User and the Service Provider by contacting the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Consumer Federation, the Association of Polish Consumers). Detailed information on the possibility for consumers to use out-of-court methods of dealing with complaints and pursuing claims, as well as the rules of access to these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and Provincial Inspectorates of Inspections. Validity and changes to the regulations

  1. The Regulations enter into force on October 1, 2018.
  2. The Regulations together with the annexes constitute the entire agreement concluded with Users.
  3. The Operator is entitled to make changes to the Regulations with future effect, e.g. in the event of a change in legal provisions, correction of errors, expansion of the Platform or change in its functionality. The Operator will inform Users about the updated Regulations on the website www.getthebox.eu/regulamin and in the Application or via e-mail indicated during Registration. The new Regulations enter into force on the day of their publication, or on another date indicated by the Operator, but the update will not violate the acquired rights of Users.
  4. The amendment to the Regulations is effective for Users who do not delete their account on the Platform or submit a declaration of termination of the contract within 14 days from the date of notification of the amendment to the Regulations, or who, before the expiry of this period, use the services provided electronically via the Platform, e.g. by logging in to the Application.
  5. If the User does not accept the changes to the Regulations, he or she should refrain from logging in to the Website and notify the Operator of such a decision within 14 days from the date of notification of the change in the Regulations. A declaration of non-acceptance of changes to the Regulations results in deletion of the User Account.
  6. A change of the Operator's data, e.g. headquarters or contact details, or a change of the personal data administrator does not constitute a change to the Regulations and does not require the application of the procedure described in section 3 above; However, the Operator is obliged to notify Users about such changes.
